The October 26 agreements combine league data and operator restrictions with a separate CFTC information-sharing memorandum whose published terms keep cooperation discretionary.

The NBA named Kalshi and Polymarket its preferred prediction market exchanges on October 26, pairing access to official league data with restrictions on NBA-related event markets. Separately, the league and the Commodity Futures Trading Commission announced an information-sharing memorandum.

The [NBA announcement](https://www.nba.com/news/nba-establishes-integrity-framework-and-commercial-partnerships-for-prediction-markets) covers commercial agreements and market-integrity requirements. [Cointelegraph reports](https://cointelegraph.com/news/nba-names-kalshi-polymarket-preferred-exchanges-signs-cftc-deal) that the exchanges will receive official data through Sportradar for operating and settling authorized NBA markets, alongside rights to use league intellectual property and run promotions in the United States.

League and team personnel are prohibited from trading NBA event contracts under the partnerships. The agreements also limit permissible markets and require information sharing for investigations into suspicious trading. DraftKings' existing NBA agreement has been extended to prediction markets, while additional operator arrangements are planned for coming weeks.

The [CFTC's separate release](https://www.cftc.gov/PressRoom/PressReleases/9314-26) confirms the memorandum and its cooperation purpose. Its [published text](https://www.cftc.gov/media/14791/CFTC-NBA_MOU/download) sets out consultations, designated contacts and information requests. Article I makes sharing discretionary and says neither party must create, maintain or supply information.

The MOU anticipates informal consultations and periodic meetings, with written information requests as needed. Information received through that channel is ordinarily treated as confidential unless its provider specifies otherwise, and its permitted uses are tied to each party's stated responsibilities.

That distinction matters: the exchange partnerships describe commercial access and operator obligations, while the regulator-league memorandum establishes a channel for cooperation. The MOU says it creates no legally binding rights or obligations and does not supersede existing laws or regulations. Those terms describe the arrangement's limits, rather than establishing that a particular market is available everywhere or that misconduct cannot occur.
